Terms and Conditions

Welcome to WalkGadgets. These Terms and Conditions (“Terms”) apply to every visit to and use of our website, as well as to every order you place with us. By using our website or placing an order, you agree to these Terms. Please read them carefully before making a purchase.

2. Scope

These Terms apply to all offers, orders and agreements between WalkGadgets and the customer, excluding any terms and conditions of the customer.

WalkGadgets may amend these Terms at any time. The version applicable at the time you place your order will remain applicable to that order.

3. Our Offer

WalkGadgets sells dog-related products, including supplies, accessories and other products for dogs, through our online store, which operates on the Shopify platform.

Despite our care in compiling our offer, the information provided may occasionally be incomplete, contain material errors, or not be up to date. Obvious mistakes or errors in the offer are not binding on us. Images are for illustrative purposes only and may differ from the actual product.

Our offer is valid while stocks last and may be changed or withdrawn at any time.

4. Prices

All prices stated are in euros (EUR), including VAT and excluding any delivery, reservation or administration costs, unless otherwise stated.

Any additional costs will be clearly displayed during the ordering process, and in any event before the order is completed.

We reserve the right to change our prices at any time. However, products will be invoiced at the price applicable at the time the order was placed.

5. Order and Formation of the Agreement

Your order is complete and the agreement between WalkGadgets and you is concluded once you confirm the order and the payment has been completed.

After placing your order, you will receive an order confirmation by email containing an overview of your order.

WalkGadgets reserves the right to refuse an order in the event of a serious suspicion of abuse of rights, bad faith, non-payment of a previous order, or if the products are no longer available.

6. Delivery

WalkGadgets delivers to Belgium and to the other member states of the European Union.

Deliveries are made to the address provided by the customer. Delivery times are indicative; delays do not entitle you to compensation unless the delay is unreasonably long.

The risk of damage to or loss of the goods passes to the customer upon delivery, except where an external carrier is appointed by WalkGadgets without the customer having a choice of carrier. In that case, the risk passes to the customer when the customer, or a third party designated by the customer, physically takes possession of the product.

Please inspect your delivery upon receipt and report any visible damage or missing products as soon as possible, and no later than within 5 business days, by contacting mvretail@outlook.be.

7. Payment

Payment is made using the payment methods offered in our online store at the time of ordering through the Shopify payment environment.

WalkGadgets may change the available payment methods at any time.

8. Right of Withdrawal

As a consumer, you have the right to withdraw from the agreement within a period of 14 calendar days without giving any reason.

The withdrawal period expires 14 calendar days after the day on which you, or a third party designated by you other than the carrier, physically receive the product. In the case of an order consisting of multiple products delivered separately, the withdrawal period expires 14 calendar days after receipt of the last product.

To exercise your right of withdrawal, you must inform us of your decision by means of an unequivocal statement, for example by email to mvretail@outlook.be.

You may also use the model withdrawal form, but this is not mandatory.

Costs in case of withdrawal: the direct costs of returning the goods are borne by you as the customer.

Refund: if you withdraw from the agreement, we will reimburse all payments received from you, including standard delivery costs, without undue delay and in any event no later than 14 days after we have been informed of your decision to withdraw.

We may wait with the refund until we have received the goods back or until you have demonstrated that you have returned the goods, whichever occurs first.

The refund will be made using the same payment method as used for the original transaction, unless expressly agreed otherwise.

Condition of the goods: you are only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Exceptions to the right of withdrawal: the right of withdrawal does not apply, or may be lost, in particular to:

• Sealed goods that are not suitable for return for reasons of health protection or hygiene and whose seal has been broken after delivery, such as certain dog grooming products;

• Goods manufactured according to your specifications or clearly personalized for you;

• Goods that deteriorate quickly or have a limited shelf life.

9. Legal Guarantee

As a consumer, you have statutory rights under the legal guarantee of conformity for goods with visible defects or defects that become apparent within 2 years from delivery.

This guarantee does not cover defects resulting from accidents, negligence, falls, use contrary to the instructions for use, or normal wear and tear.

To make a claim under the guarantee, please contact us at mvretail@outlook.be, stating your order number and providing a description of the defect.

10. Complaints and Liability

Complaints concerning delivered products do not make us liable for any consequential damages, except in cases of intent or gross negligence.

In any event, our liability is limited to the amount of the relevant order.

WalkGadgets is not liable for damage resulting from improper or incorrect use of the products.

11. Intellectual Property

The content of our website, including texts, images, logos and product photographs, is protected by intellectual property rights and remains the property of WalkGadgets or its suppliers.

Use of this content without prior written permission is not permitted.

12. Privacy

The processing of your personal data is carried out in accordance with our separate Privacy Policy, which is available on our website.

13. Force Majeure

In the event of force majeure, WalkGadgets is not required to fulfill its obligations.

In such circumstances, we may suspend our obligations for the duration of the force majeure event or terminate the agreement.

14. Applicable Law and Disputes

All agreements between WalkGadgets and the customer are governed by Belgian law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG), without prejudice to the application of mandatory consumer protection provisions in the country where you, as a consumer, have your habitual residence.

In the event of a dispute, if an amicable solution cannot be reached, the courts of the jurisdiction where WalkGadgets has its registered office shall have jurisdiction, unless mandatory law provides for another competent court.

Consumers may also make use of the European Commission’s ODR platform for the out-of-court resolution of disputes.
